§ 2-2-18. Same—Initial election, terms, etc.

  • Notwithstanding those changes in descriptions of commissioner districts which become effective under Section 2 of this Act [2-2-17] at the same time this section becomes effective, the elections and terms of the initial and subsequent members of the Board of Commissioners of Henry County under said Section 2 [2-2-17] shall not be changed but shall remain as follows:

    (a)

    (1)

    Effective January 1, 1983, the commissioners representing commissioner districts 1, 2, and 3 under Section 2 [Section 2-2-17] shall be the former commissioners representing commissioner districts 1, 2, and 3 who were elected at the general election of 1980 under previously existing provisions of the act [article], and said commissioners so elected shall serve for the terms of office to which they were elected, which terms shall expire at the end of December 31, 1984, and upon the election and qualification of their successors. Their successors shall be elected at the general election of 1984 and shall take office on January 1, 1985, for terms of four (4) years and until their successors are elected and qualified. Thereafter, successors shall be elected at the general election immediately preceding the expiration of the terms of office and shall take office on the first day of January immediately following their election for terms of four (4) years and until their successors are elected and qualified.

    (2)

    The members of the board of commissioners serving on July 1, 2011, shall continue to serve the remainder of their terms and until their successors are duly elected and qualified. The successor to the commissioner from Commissioner District 3 shall be elected at the general election in 2012 and shall take office on January 1, 2013, to serve a term of two (2) years. His or her successors shall be elected quadrennially thereafter to serve terms of four (4) years. The terms of office of the remaining commissioners shall be unaffected by the provisions of this paragraph.

    (b)

    The commissioners representing commissioner districts 4 and 5 shall be elected at the general election of 1982 and shall take office on January 1, 1983, for terms of four (4) years and until their successors are elected and qualified. Thereafter, successors shall be elected at the general election immediately preceding the expiration of terms and shall take office on the first day of January immediately following their election for terms of four (4) years and until their successors are elected and qualified.
