§ 3-16-41. Definitions.

  • For the purpose of this article, the following words and terms shall have the meanings respectively ascribed:

    Litter means all sand, gravel, slag, brickbats, rubbish, waste materials, tin cans, household refuse, discarded items, garbage, trash, debris, junk, used lumber, used building materials, dead animals, metal, abandoned autos or machinery.

    This is not to include litter placed in proper containers for the purpose of pickup by private contract garbage haulers. This is not to include sand or gravel placed on private property by the owner of such property or with the express consent of the owner of such property as long as a nuisance is not created.

    Public or private property; areas of enforcement means the right-of-way of any public road, any property owned or operated by Henry County; any public playground, body of water or watercourse, recreation area, residential or farm property; or any other property not designated or approved by state or county authority as a landfill.
