§ 3-16-44. Penalties—Generally.

  • Any person violating the provisions of this article shall, upon conviction in the Magistrate Court of Henry County, Georgia, or upon plea of guilty or nolo contendere, be punished by a fine not to exceed five hundred dollars ($500.00) and/or up to sixty (60) days in the Henry County Detention Facility. In addition to the fine and jail sentence, the judge may impose mandatory community service whenever any litter is found to contain any article or articles, including but not limited to, letters, bills, publications or other writings which contain the name of a person in such a manner as to indicate that the article or articles belong to such a person. The judge may direct that person to pick up or remove from any public street or highway, or public right-of-way, not to exceed one (1) mile, any litter he or she has deposited and any and all litter deposited thereon by anyone else prior to the date of sentence and, in addition, with the permission of the legal owner or tenant in lawful possession of any such private property upon which it can be established that he or she is depositing litter, the judge may require such person or persons to pick up and remove all litter from the property whether placed by such person or someone else prior to the date of sentence.
