§ 3-17-1. Hauling building materials at night.

  • (a)

    It shall be unlawful for any person to haul or transport any building materials by means of any vehicle during the period of time between thirty (30) minutes after sunset and thirty (30) minutes before sunrise unless the driver of the vehicle has in his possession documents establishing the ownership of such building materials or the vehicle is owned by a government entity or public utility and is operated by an authorized employee of such governmental entity or utility, or the vehicle is subject to regulations of the Georgia Public Service Commission or the Interstate Commerce Commission. As used in this Section, "building materials" shall mean and include any new materials customarily used in building or construction work and which have a reasonable fair market value in excess of one hundred dollars ($100.00).

    (b)

    Any person violating the provisions of subsection (a) shall be fined up to a maximum of five hundred dollars ($500.00).
