§ 3-5-113. Penalties.

  • (a)

    Any person, firm or corporation or an employee or agent of any firm or entity pleading guilty, nolo contendere or having after trial being found guilty of violating any provision of this ordinance may be fined up to one thousand dollars ($1,000.00) and/or sixty (60) days in jail per violation. Each day a violation continues shall be a separate offense. However, this section shall not preclude the county from seeking civil redress in a court of competent jurisdiction in addition [to] the criminal prosecution. It being the intent the county has both civil and criminal right of prosecution in this area.

    (b)

    In the case of an improper waste disposal site, the owner, contractor, developer, builder or other person managing the property shall clean up the site and come into full compliance with this article. Henry County shall not be responsible for any costs of remediation. The offender may be fined one thousand dollars ($1,000.00) for each day a violation continues to exist, and business license may be revoked, or suspended, as deemed by the board of commissioners.
