§ 3-5-225. Rate schedules.

  • (a)

    All water and sewer rates for the consumers of the authority shall be set from time to time by the authority without the approval of the county. However, water rates will not increase without thirty (30) days' notice to the consumer. Notice will be sufficiently given to the consumer by a publication of the rate changes once a week for four (4) weeks in the official newspaper of Henry County prior to the rate increase.

    (b)

    Effective March 1, 1993:

    (1)

    The water rates for residential, industrial and commercial customers with a meter of one inch or less shall be as follows:

    The minimum monthly charge for water meters in excess of one inch in diameter for residential, industrial and commercial customers shall be as follows:

    (3)

    (c)

    (d)

    Municipal consumers of the water authority located in Henry County shall pay on a monthly basis one dollar and fifty-five cents ($1.55) per thousand gallons for water purchased by a municipality from the authority; however, said rate shall be phased in as follows:

    March 1, 1993       $1.08 (per thousand gallons)
    June 1, 1993       1.31 (per thousand gallons)
    September 1, 1993       1.55 (per thousand gallons)

    (e)

    Water meters shall be classified as either "active meters," "inactive meters," "cancelled meters," "line extension meters" or "subdivision meters." Said meters are further defined as follows:

    (1)

    Active meters are defined as meters that are in use or that were purchased after August 1, 1983. All "active meters" will be charged on a monthly basis the rates set forth above. If an "active meter" is not used for a period of six (6) months after installation, or if the customer requests in writing that service be temporarily discontinued, then the meter shall be classified as an "inactive meter" and shall be treated as hereinafter provided. A customer can maintain an "active meter" status by paying a monthly minimum water bill provided for herein.

    (2)

    Inactive meters are defined as meters that are installed, but have not been used by the customer for a period of six (6) months or the customer has notified the authority in writing to temporarily terminate service. If a meter remains unused for a period of six (6) months, or the customer requests in writing that service be temporarily terminated, the authority will seal the meter and declare the meter an "inactive meter." If a customer desires to obtain water services after the meter has been declared inactive, the customer shall pay the authority a reconnection fee of one hundred fifty dollars ($150.00) together with any previous bills assessed against said meter prior to obtaining any additional service from the authority. Once the connection fee and any past due bills have been paid, the meter will be re-classified as an "active meter" as defined above.

    (3)

    Canceled meters are defined as meters that are installed but are not used for a period of twelve (12) months, or the customer has notified the authority that the customer does not desire to obtain any further water service from the authority. If a meter is declared a "cancelled meter," the meter will be removed and the connection sealed. A customer desiring reconnection of a "cancelled meter" shall pay the tap-on fee that is in effect as of the date of the application.

    (4)

    Line extension meters are defined as meters purchased to aid in line extensions, but the customer has not requested that the meter be installed. At the time of the purchase of the meter, the authority anticipated that the customer would connect on to the water system within a reasonable time. A number of "line extension meters" have been purchased, but the customer has not requested that the meter be installed. Due to the customer's failure to connect on to the line extension, pay the minimum monthly water bill, the authority cannot recoup the cost of the line as originally anticipated. Any customer holding a line extension meter who fails to connect on prior to January 1, 1985, shall be assessed an additional connection fee of one hundred fifty dollars ($150.00) at the time of connection. The customer may avoid the payment of the additional connection fee by paying the minimum monthly water bill until such time as the meter is connected, at which time the meter will be classified as an "active meter" as defined above.

    Subdivision meters are defined as meters that were purchased for installation in subdivisions in which the water lines were constructed and installed at no expense to the authority. Any "subdivision meters" that were purchased prior to August 1, 1983, that are not installed prior to January 1, 1985, shall be charged [for by] an additional connection fee of one hundred fifty dollars ($150.00). This charge is assessed because of the increased cost of operation and maintenance of the water system of Henry County. "Subdivision meters" that are installed but do not become "active meters" by January 1, 1984, will be classified as "inactive meters" and shall be governed as such.

    (f)

    All customers who pay a connection fee to the authority after August 1, 1983, will be required to pay the minimum monthly charge as set forth above commencing ninety (90) days after the date of payment of the connection fee or on the next billing date after connection, whichever occurs first. The monthly minimum charge set forth above shall be paid whether the meter has been installed or not.
