§ 3-5-383. Restricted use of certain land.

(a)

Any property lying adjacent or within one thousand (1,000) feet to any property owned, managed, maintained or operated by the county or the Henry County Water and Sewerage Authority as an existing water reservoir within the T.W.P.D. or any property that is designated by the county or the Henry County Water and Sewerage Authority as a reservoir within the T.W.P.D. shall have in addition to the restrictive uses hereinafter set out the following restrictions:

(1)

Permitted Residential Uses:

a.

Minimum lot size: three (3) acres.

b.

Minimum Setback Lines for Buildings or Structures: two hundred fifty (250) feet.

c.

Minimum Setback Lines for Nitrification Field Lines: two hundred fifty (250) feet.

(2)

Permitted Agricultural Uses:

a.

Minimum Setback Lines for Building or Structures: Two hundred fifty (250) feet.

b.

Minimum Setback Lines for Nitrification Field Lines: Two hundred fifty (250) feet.

c.

Minimum Setback Lines for Cultivation: Two hundred fifty (250) feet.

Commercial: No commercial structures or uses of any nature.

(4)

Industrial: No industrial structures or uses of any nature.

(b)

The following restrictions and limitations shall apply to all other properties that are not located in specified areas set forth in subsection above:

(1)

Permitted Residential Use:

a.

Single-Family Dwellings—Minimum Lot Size: One and one-quarter (1¼) acres (unless served by public sewerage).

b.

Multi-family dwellings which are served by public sewerage.

c.

Minimum Setback lines for Building or Structure for Single and Multi-Family Dwellings: One hundred (100) feet.

d.

Minimum Setback lines for Nitrification Field Line for Single Family Dwelling: One hundred (100) feet.

(2)

Permitted Agricultural Use:

a.

Minimum Setback Lines for Building or Structure: One hundred (100) feet.

b.

Minimum Setback Lines for Nitrification Field Line: One hundred (100) feet.

(3)

Permitted Commercial Use:

a.

Minimum Lot Size: One and one-quarter (1¼) acres.

b.

Minimum Setback Lines for Structure, Accessory Building or Parking Lot: Two hundred (200) feet.

c.

Minimum Setback lines for Nitrification Field Lines: Two hundred (200) feet.

Permitted Industrial Use:

a.

Minimum Lot Size: Five (5) acres.

b.

Minimum Setback Lines for Structure, Accessory Building or Parking Lot: Two hundred (200) feet.

c.

Minimum Setback Lines for Nitrification Field Lines: Two hundred (200) feet.
