§ 3-2-4. Conflicts of interest.

  • (a)

    No company shall sell any supplies, equipment, goods, or any type of personal property in which a board member, commission member, or authority board member has any financial interest to the county.

    (b)

    A board member may sell goods or products to another county board, or authority where they do not sit as a member.

    (c)

    No board member, commission member, authority member, or employee shall give gifts, entertainment or any other personal favor to, any corporation, entity or organization with whom or with which Henry County may have or is likely to have business dealings.

    (d)

    Except as provided for herein, no board member, commission member, authority member or employee may accept any noncash personal gift over fifty dollars ($50.00) in value from any person, private firm or corporation. In no case shall any board member, commission member, authority member or employee accept any cash gift or payment of any kind. Members of the board of commissioners may accept complimentary tickets or admission to events, meetings, seminars or other gatherings where such attendance could serve the county by providing access to local, state or federal business, civic or government leaders.

    (e)

    Each board or authority member and any person employed in any capacity by each board or authority is required to disclose any outside activities, interest or investments that conflict, or suggest potential conflict, with the best interest of Henry County.

    (f)

    No board or authority member and any person employed in any capacity by each board or authority shall participate in any decision-making process relative to the business of Henry County where that board member has the potential to gain some personal profit from the decision to be made, or because of some personal interest in the matter before the board which the board member may be prevented from, or may appear to have been prevented from, making an unbiased decision with respect to the matter.

    (g)

    In any decision-making process of the county board of commissioners, or any of its authorities or commissions, immediately upon a potential conflict of interest of a board member becoming apparent to that board member, the board member shall immediately inform the board of the potential conflict and shall immediately terminate all involvement and input into the relevant decision-making process regarding the conflict of interest matter.

    (h)

    If any board member, authority member or any person employed in any capacity by each board or authority violates the provisions of this section, all relevant information shall be turned over to the appropriate authorities by the board of commissioners for investigation and possible prosecution.

    (i)

    The county board of commissioners shall require that all board and authority members, present and future, shall, in writing, agree to uphold the policies herein set out.
