§ 3-5-105. Residential service.

  • All licensees shall provide a minimum of the following services:

    (1)

    Weekly curb service collection of residential waste packaged as approved pursuant to section 3-5-108 of this article, except as otherwise set forth herein. Each licensee shall set uniform fees for collection. Charges for residential collection and removal services shall be charged to the owners of the real property served, except that by requesting services, any tenant may become jointly bound to pay for the service. Uniform rates for a licensee's services shall be maintained within that zone for which the license is granted. However, in sparsely populated areas of a zone where the expenses for collection are greater, the licensee may charge a higher rate, not to exceed fifteen (15) percent over and above that amount charged all others in the same zone.

    (2)

    Collection for disabled persons and senior citizens sixty-five (65) or older as defined in section 3-5-106 shall be made and billed as directed in that section.

    (3)

    All residential customers shall participate in recycling. At least monthly, licensee's shall collect items from a county approved list of recyclables. The board of commissioners reserves the right to change the type and number of recovered materials, and to re-determine collection and disposal of yard trimmings. Licensees shall provide a proper mechanism for recycling. Licensees shall not dispose of recovered materials in landfills. All licensees shall participate fully in recycling. It is the intent of this section, all zones and licensees will have recycling at the curb no later than July 1, 1996.

    (4)

    Upon recovered materials being placed in designated recycling containers for collection, they shall become the property of the licensee. During the twenty-four-hour period commencing at 7:00 p.m. on any day preceding a day designated for collection of recovered materials, no person other than an employee or agent of licensee shall remove recovered material from the designated recycling container. Any unauthorized person collecting or attempting collection of a recovered material in violation of this section shall constitute a violation of this ordinance, and shall be punishable as provided in section 3-5-113. Nothing herein shall be construed to limit the right of any individual, organization or other entity to donate, sell or otherwise dispose of recovered materials, if such disposal does not violate any applicable statute, regulation or ordinance.

    (5)

    Provide total service to zone or zones selected. Accommodations for pickup of special wastes within that zone shall be made by licensee. Special fees to cover the service can be charged but must be announced to the customer at the time fees for service are considered by customer.

    (6)

    The board of commissioners reserves the right, to direct and control the time, place and manner of solid waste handling. Nothing in this article is intended to abridge Henry County's right to own or regulate the waste stream.
